Consumer courts are not meant for enriching the consumers

The Delhi State Commission on the question of amount of compensation in consumer oriented cases opined that “consumer courts are not meant for enriching of customers and the compensation claimed by the consumer in the complaint should be proportionate and justified keeping in view of the price of the product”

Challenge

The appellant moved the consumer district forum praying for the refund amount and also an amount of Rs. 50,000/- towards compensation for mental agony and harassment. The district forum held opposite party no. 3 liable for deficiency of services and awarded Rs. 10,000/- towards compensation and also the refund amount. Aggrieved by the amount of compensation, the appellant filed the present appeal.

Held

The State Commission dismissed the appeal and held that “in view of the price of the product, there is no illegality in awarding the amount of Rs. 10.000/- and it also will not be justified to award the compensation of Rs. 50,000/- as the appellant has not produced any documentary evidence to show how he had suffered the loss of that amount.”
